Medical Malpractice suites are expensive for both sides
and outcomes could take years
Medical malpractice suits are becoming
mainstay and many lawyers are looking for cases. The outcome is usually
the same. If there is injury there will be a reward. The lawyer must make
a determination right from the beginning if he believes there is
sufficient injury to pay his costs.
There are many reasons for this type of case. It’s
not always the doctors fault. There may be assistants that have made
errors or anesthesiologists who apply the wrong gas or medication because
they are ignorant of the patients history. Hospitals can be at fault by
not admitting a patient, for whatever reason, and later the patient dies
or becomes permanently disabled. Misdiagnosis can be a factor if the
result is injury.
Malpractice lawsuits raise the cost of medical
insurance for the patient and the doctor, mostly for the doctor. Doctors
pay an exorbitant amount for malpractice insurance and naturally that cost
is passed down to the patient. Many small doctors offices just go out of
business trying to keep up with the payments.
The cost of running a doctors office is daunting
enough without the hefty insurances involved. Medical equipment can be
staggeringly expensive and necessary to perform in-house surgery and
diagnostics.
Misreading a doctors handwriting can cause the wrong
prescription to be filled or the wrong amount or inappropriate directions.
A pharmacy will usually call the doctors office if they are not sure. Many
will not even issue the prescription before talking to the doctors office,
however, with online ordering this is not always the case.
Malpractice laws differ from state to state. http://www.mcandl.com/states.html
lists the laws for each of the states in the U.S.
In all malpractice cases a medical expert must be
retained to determine if there is a case. Cases can take several years to
conclude if no settlement is made.
